This Retail Merchant Disclosures document applies only to products sold directly by Kingston Express through the Kingston Express platform.
Where an item is sold by Kingston Express, Kingston Express acts as the merchant of record and assumes the seller obligations described below.
1. IDENTIFICATION OF SELLER #
Products covered by this disclosure will be clearly identified on the product page as:
“Sold by Kingston Express”
If a product is sold by a third-party seller, that seller will be identified separately, and different terms may apply.
2. ROLE OF KINGSTON EXPRESS #
For items sold by Kingston Express:
- Kingston Express is the retailer and seller of record
- Kingston Express is responsible for pricing, order fulfillment, and customer service
- Kingston Express is responsible for applicable warranties and consumer obligations
For clarity, Kingston Express’s role as a retailer is separate from its role as a marketplace operator for third-party sellers.
3. WARRANTIES FOR KE-SOLD ITEMS #
3.1 Statutory Warranties #
KE-sold items may be subject to statutory warranties or consumer guarantees required under applicable Jamaican consumer protection laws.
These rights apply regardless of any manufacturer warranty.
3.2 Manufacturer Warranties #
Where applicable, KE-sold items may also be covered by a manufacturer’s warranty.
Manufacturer warranties:
- Are provided by the manufacturer, not Kingston Express
- May have separate terms and conditions
- Do not limit statutory consumer rights
3.3 Warranty Exclusions #
Warranty coverage may not apply where:
- Damage results from misuse, abuse, or unauthorized modification
- Normal wear and tear occurs
- Products are used contrary to instructions
4. RETURNS, REFUNDS & AFTER-SALES SUPPORT #
Returns, refunds, and exchanges for KE-sold items are handled directly by Kingston Express in accordance with the Returns, Refunds & Cancellations Policy.
Where an item is defective, damaged, or not as described, Kingston Express will provide remedies in line with applicable law.
5. CONSUMER RIGHTS DISCLOSURE #
Nothing in this disclosure limits or excludes any rights you may have under applicable consumer protection laws.
Consumers may be entitled to remedies such as repair, replacement, refund, or other relief depending on the circumstances.
6. DELIVERY & DISPATCHMENT #
Delivery of KE-sold items may be handled directly by Kingston Express or through Dispatched by Kingston Express services.
Delivery timelines are estimates and are subject to the Delivery, Shipping & Dispatchment Policy.
